There is no legal requirement to have an asbestos survey to sell a domestic home in the UK. However, a survey is often sensible: a buyer’s surveyor may flag suspect materials, lenders can ask questions, and knowing in advance prevents a sale falling through. For commercial property and rentals, the duty to manage asbestos does apply.
Selling a home
Sellers are not legally obliged to survey for asbestos, but if a buyer’s RICS survey notes a textured ceiling, a cement garage roof or suspect insulation, it can stall negotiations or trigger a retention. A quick management survey lets you answer with evidence rather than uncertainty.
Buying a home
If a homebuyer survey mentions possible asbestos, do not panic — it is extremely common in pre-2000 housing and is usually manageable. A focused asbestos survey tells you exactly what is there, its condition, and what (if anything) needs doing, so you can budget or negotiate accurately.
When it is a legal duty
The Control of Asbestos Regulations 2012 place a “duty to manage” on those responsible for non-domestic premises — including the common parts of blocks of flats, and properties you let out. If that is you, a management survey and asbestos register are required.
